The aim of this paper is to reflect on the way in which the harmonization of the traditional penal system to the demands of multiculturalism of contemporary societies can contribute to the achievement of the common good. After analyzing the need for the punitive reaction to culturally motivated crimes to take into account the cultural diversity of the perpetrators, especially in the Chilean context, emphasis is placed on some criminal policy proposals which, as general guidelines, should be consider by the Chilean public authorities.
