dc.description.abstractEl presente estudio hace un repaso cronológico a las sentencias con las que el Tribunal Europeo de Derechos Humanos ha condenado a España por su perseverante protección del honor de sus instituciones y autoridades mediante el empleo del Derecho penal. A pesar de la taxatividad de los pronunciamientos del Tribunal Europeo de Derechos Humanos (TEDH) en Castells y Otegi Mondragon, Gobierno y Justicia perduran sobreprotegiendo sus instituciones escudándose ahora en una retorcida interpretación de la efímera doctrina del discurso del odio que no conduce sino a complicar la coexistencia en una sociedad tan diversa y plural como la española. El último de los pronunciamientos del TEDH, Stern Taulats y Roura Capella vs. España, acaba de llegar en un momento realmente crucial para la arena política española. La convergencia del inverosímil desafío político-separatista catalán, con esta última condena a la protección penal de las instituciones y sus autoridades frente a la crítica política ultrajante, urge a una profunda adaptación del modelo de Estado en Españaes_ES
dc.description.abstractThe present study aims to give a chronological review of the European Court of Human Rights case law that condemned Spain for its persevering protection of the honor of its institutions and authorities using criminal law. Despite the exhaustiveness of the European Court of Human Rights (ECHR) statements in Castells and Otegi Mondragon, Government and Justice continue to protect their institutions by applying a twisted interpretation of the ephemeral doctrine of hate speech that only leads to a complication of the coexistence in a society as diverse and plural as the Spanish. The last of the pronouncements of the ECHR, Stern Taulats and Roura Capella vs. Spain, has arrived in a crucial moment for the Spanish political arena. The convergence of the disingenuos political-separatist challenge in Catalunya and this sentence on the criminal protection of institutions and their authorities facing the outrageous political criticism, calls for a profound review of the State model in Spaines_ES
