dc.description.abstractEn relación con el debatido tema, referente a que exista la posibilidad de que la Universidad comercialice los resultados que se obtengan de sus investigaciones o, en detrimento de ello, que las empresas privadas se conviertan en propietarias de invenciones que se han obtenido con financiamiento público, no obstante, a pesar de las diferentes opiniones gran parte de la doctrina y de las políticas de I+D seguida por las principales universidades del mundo, demuestra que la solución de transferir los resultados de la investigación no solo es posible, sino también deseable. En el espacio universitario entre las cuestiones que merecen mayor atención se encuentran la relacionada con la titularidad formal (es decir, si el derecho al título de propiedad intelectual ha de corresponder al inventor o creador, o por el contrario, debe atribuirse a la Universidad en la cual aquel desarrolla su investigación) y por otro lado la titularidad desde un punto de vista sustancial (esto es, determinar si han de distribuirse y cómo los beneficios que se obtengan por la explotación de la innovación tecnológica generada por la investigación). De este modo, cada día son más necesarios estudios que aborden el régimen legal de las invenciones obtenidas en el marco de un contrato laboral o de prestación de servicios, porque, al parecer, la figura del solitario inventor que en su laboratorio obtiene ingeniosamente una invención tiende a desaparecer.en_US
dc.description.abstractIn relation to the debated topic, regarding the possibility that the University commercializes the results obtained from its research or, to the detriment of this, that private companies become owners of inventions that have been obtained with public financing However, despite the different opinions, a large part of the doctrine and R & D policies followed by the worlds leading universities show that the solution of transferring the results of research is not only possible, but also desirable. . In the university space among the issues that deserve more attention are those related to formal ownership (that is, if the right to the title of intellectual property has to correspond to the inventor or creator, or on the contrary, it must be attributed to the University in which one develops its investigation) and on the other hand the ownership from a substantial point of view (that is, to determine if they are to be distributed and how the benefits obtained by the exploitation of the technological innovation generated by the research). In this way, more and more studies are needed that address the legal regime of inventions obtained in the framework of an employment or service contract, because, apparently, the figure of the solitary inventor who in his laboratory ingeniously obtains an invention it tends to disappear.
