Abstract
El presente artículo se centra en reclamar el reconocimiento y regulación en
el proceso civil español, a diferencia de lo que acontece en la actualidad de
la llamada “tutela mandamental”. Ello obedece a que las “acciones y sentencias
de mandamiento” constituyen, sin duda, un magnífico instrumento
en orden a conseguir, con claro respeto del derecho fundamental a la tutela
judicial efectiva, un proceso civil más eficaz.
This article is focused on claiming the acknowledgement and regulation in the Spanish civil trial of the so-called “tutela mandamental” (“mandate protection”), against what happens nowadays. This relies on the fact that the “mandate judgements and actions” form, no doubt, an excellent instrument aimed at achieving a more effective civil trial, clearly observing the fundamental right to the actual judicial protection.
