Abstract
Como una forma de descongestionar los tribunales de familia, la
Ley 20.286 establece en Chile, entre otras medidas, la mediación obligatoria
previa a la interposición de la demanda en determinadas materias de
familia. Esta investigación contempla un estudio de la mediación como una
forma alternativa de resolución de conflictos en derecho de familia desde
diversas perspectivas y pretende efectuar un análisis crítico del mecanismo
de mediación obligatoria en nuestra legislación.
As a way of clearing the courts of family, the Law Number 20.286 establishes in Chile, between other measures, the obligatory mediation before the interposition of the demand in certain matters of family. This investigation contemplates a study of the mediation as an alternative form of resolution of conflicts in family right from diverse perspectives and tries to effect a critical analysis of the incorporation of the mechanism of previous obligatory mediation in our country.
