Abstract
En el marco del nuevo paradigma de la responsabilidad penal juvenil los servicios
de administración de justicia deben adecuar sus procedimientos y herramientas a
fin de permitir que las medidas socioeducativas cumplan con su finalidad específica.
Basados en los conceptos de justicia restaurativa, con el aporte multidisciplinario,
una fuerte raigambre en los derechos humanos fundamentales y la participación
comunitaria, los modelos de métodos alternativos de resolución de controversias,
como la mediación, vienen a ocupar un lugar privilegiado para el abordaje de
la problemática de los jóvenes a quienes se les atribuya la comisión de actos que
encuadren en infracciones a la norma penal.
El sistema penal tradicional además de ser un reproductor de la violencia a través
de las respuestas coercitivas y la estigmatización, no brinda el espacio para una
positiva responsabilización, la reparación del daño y la reactivación de los vínculos
sociales.
Más que una salida alternativa al procedimiento judicial se trata de una verdadera
práctica transformadora tendiente a desarrollar el potencial de cambio en los
jóvenes, para que puedan, a través de la participación en un espacio de diálogo, ser
protagonistas de la construcción de su personalidad autónoma.
Within the frame of the new paradigm of juvenile criminal responsibility, the cervices of administration of the law must adapt their procedures and tools so as to allow socio-educational measures to achieve their specific aim. Based on the concepts of restorative justice, with a multidisciplinary contribution, a strong support on basic human rights and community participation, the models of alternative methods of resolution of controversies, such as mediation, come to play a privileged part in the approach to problems of young people who are charged with committing acts of infringement of the criminal law. The traditional criminal system, apart from breeding violence through restraining answers and stigmatization, it does not offer the space for taking positive responsibility, the restoration of damages and the reactivation of social bonds. Rather than an alternative way out of the legal procedures, it is a truly transformational practice leading to the development of young people's potential for change, so that they can, by means of their participation in a space for dialogue, be protagonists in the construction of their autonomous personality.
