Control in limine de admisibilidad en el derecho chileno ante el Juez de Familia y derechos fundamentales procesales

Abstract
En la normativa chilena reguladora del derecho de familia, el artículo 1 n°12 de la Ley N° 20. 286, que introduce modificaciones a la Ley que Crea los Tribunales de Familia (N°19.968), otorga un control de admisibilidad al juez que contempla la posibilidad de rechazar de plano una presentación por considerarla «manifiestamente improcedente». Dicha potestad, que tiene como fundamento, principalmente, el intento por descongestionar estos tribunales, carece de una regulación expresa en la ley respecto su ámbito de aplicación, lo que unido a las modificaciones procedimentales incorporadas en la justicia familiar, hacen posible estimar que su aplicación vulneraría el derecho a la tutela efectiva y el derecho a ser oído, íntimamente relacionados con el derecho al debido proceso.
Article 1 n°12 of the Law 20.286, which introduces modifications to the Law on Creation of the Family Courts, grants a control of admissibility to the judge and contemplates the possibility of completely rejecting a submission if considered «manifestly inadmissible». The above mentioned attribution which mainly attemptsto clear the case backlog in the Family Courts lacks express regulation in the law with respect to the area of its application. The latter together with the procedural modifications incor- porated into the Law 19 . 968 make possible to estimate that its application would infringe the right to the effective judicial protection and the right to be heard; both intimately related to the right of due process.
