| dc.description.abstract | La hipótesis central de esta investigación consiste en determinar que la necesidad de la reformulación de la justicia civil, radica en adecuarse a los estándares que la Corte Interamericana de Derechos Humanos ha establecido sobre el debido proceso. Para el cumplimiento de tal meta argumentaremos que dicho resultado no puede alcanzarse por la vía de la adecuación de la actual legislación a ciertas garantías. En tal sentido, resulta necesario un cambio de paradigma entorno a los principios que informan el proceso civil en Chile. Es por este cambio en las bases sobre los cuales se erige el proceso que resulta indispensable la implementación de un nuevo Código Procesal Civil. Mediante esta obra, el lector podrá apreciar, especialmente en su parte dispositiva, que para adecuarnos a los estándares de debido proceso impuestos por la Corte IDH, será necesario una reformulación en la esencia del proceso, lo cual no puede ser alcanzado mediante parcialidades, sino más bien mediante la promulgación de un Código Procesal Civil | |
| dc.description.abstract | The central hypothesis of this investigation is to determine that the need for reformulation of civil justice in Chile lies in adapting to the standards for due process established by the Inter-American Court of Human Rights. To achieve this goal, the present paper will argue that this result cannot be achieved by adapting our civil procedural law to certain rights. A paradigm shift is required in the principles that inform civil process in Chile. It is this change in the foundations on which process rests that makes the implementation of a new Civil Procedural Code indispensable. In this paper, especially in the proposals that it offers, the reader will appreciate that the only way to adjust the Chilean Code to the standards of due process established by the Inter-American Court of Human Rights is by reformulating the essence of process. This cannot be achieved by partial reforms, but by the promulgation of a new Civil Procedural Code | en_US |
