dc.description.abstractEste artículo tiene como objetivo establecer que los parámetros legales para identificar a los pueblos indígenas limitan la aplicación del principio de autoidentificación en el Perú. Para ello, se examinan las normas internacionales sobre derechos humanos que consagran la autoidentificación como criterio fundamental. Luego, se explican los antecedentes de la terminología constitucional y legal sobre pueblos indígenas para tener una visión histórica sobre su tratamiento jurídico. Finalmente, como consecuencia de la aplicación de la Ley de Consulta Previa y considerando el contexto extractivo, se discutirán los primeros obstáculos que algunas comunidades han enfrentado para ser considerados pueblos indígenasen_US
dc.description.abstractThis article aims to establish that the legal parameters to identify indigenous peoples in Peru limit the application of the self-identification principle. In order to achieve this objective, the international standards on human rights that enshrine the self-identification as a fundamental criterion are examined. Then, the background of the constitutional and legal terminology to refer to indigenous peoples in Peru is also explained in order to understand why this issue has become a critical one. Finally, as a consequence of the application of the Law of Prior Consultation and considering the extractive context, the first obstacles that some communities have faced to be considered as indigenous peoples will be discusseden_US
