Abstract
Esta investigación trata acerca del conocimiento, la opinión y la percepción que tienen los profesionales de la Justicia en la Región de Murcia sobre
la Mediación Penal, así como su posibilidad de implantación. El método cuantitativo se configuró a partir de la técnica de la encuesta. La muestra utilizada ha sido de 33 personas, relacionadas con el ámbito judicial. Los principales resultados destacan que es una buena alternativa porque se podrían resolver conflictos de tipo no material, tales como los componentes psicológicos, emocionales y de relación. Se apuntan como ventajas la rapidez del proceso y la posibilidad de una mayor comunicación entre las partes. Entre los inconvenientes se destacaron la posibilidad de utilización de la mediación por parte del ofensor para obtener únicamente un beneficio propio. Para la víctima las ventajas se centran en comprender la situación del agresor, la comprensión de los hechos que rodearon la situación, reducir o eliminar los miedos que puede tener a la repetición de los hechos, así como la posibilidad de llegar a un acuerdo satisfactorio. Respecto a los ofensores, se destacaron como ventajas la posibilidad de rebajar la pena, así como beneficios de tipo psicológico: la posibilidad de pedir perdón o el reconocimiento de los hechos
This work collects information about knowledge, opinion and understanding that law professionals in Murcia have about penal mediation, and the possibility of its establishment. The quantitative method was configured from the technique used, the survey. The sample has been of 33 persons. These persons were in relation with judicial field. The main results stand out that is a good alternative because it could be solved all kind of non-material conflicts, such as psychological, emotional and relational components. The most prominent advantages are the speed of the process and the possibility of a larger communication between involved parts. The most prominent disadvantages is that offenders could use mediation in order to obtain an own benefit. For victims, the advantages are understand aggresor’s situation, the comprehension of facts around the situation, reduce or eliminate fears that they can have about repeating the incidents or the chance of reaching a satisfactory agreement. With respect to offenders, the most prominent advantages are reduce the punishment, psychological benefits and the chance of apologizing just like recognize the incidents
