Abstract
La huelga de hambre es una forma de protesta social, pacífica y extrema al mismo tiempo, en la que se tensionan valores esenciales del individuo, como la vida y la libertad, contenidos ambos en el núcleo mismo de la dignidad Humana. Sobre esta base, estudiamos los alcances de la huelga de hambre, desde sus fundamentos éticos esenciales hasta su dimensión jurídica y constitucional.
Entre otros, se revisan los debates en materia de derechos fundamentales, algunas propuestas de tratamiento penal y las colisiones con los derechos de la infancia y adolescencia. En particular, se aborda el tratamiento jurisprudencial que le han dado los Tribunales Superiores de Justicia en Chile, formulando un juicio crítico, fundado en una ética de la Dignidad Humana y en las garantías fundamentales propiamente tales, frente a discutibles argumentaciones jurisprudenciales que han privilegiado soluciones contingentes.
The hunger strike is a form of social protest, peaceful and extreme at the same time, in which the individual's essential values are stress, like life and liberty. Both values are contained in the core of human dignity. On this basis, we study the effect of the hunger strike, from the ethical ground, legal and even constitutional dimension. Among others, we review the debate about the fundamental rights, some proposals of criminal treatment and the collisions with the rights of children and adolescents. In particular, we work on the jurisprudential treatment that have given the Superior Courts of Justice in Chile, developing a critical judgment based on an ethic of human dignity and fundamental guarantees properly, in front of questionable jurisprudential arguments that have privileged contingent solutions.
