Abstract
La policía, en su actividad relacionada con el proceso penal, lleva
a cabo con frecuencia la atribución de la comisión de una infracción
criminal contra alguna persona determinada y, si se cumplen ciertas circunstancias
previstas por la ley, está obligada a proceder a la detención. En
este artículo se examina, desde la perspectiva del derecho español, algunas
cuestiones específicas que se plantean en torno a los presupuestos legales
concretos, las diversas finalidades que se persiguen, los problemas sobre la
duración de la privación policial de la libertad, así como las complejidades
del régimen jurídico del detenido, teniendo en cuenta también los casos especiales
del enjuiciamiento rápido, los procesos por terrorismo, los casos de
menores detenidos y de los extranjeros, además del procedimiento previsto
en concreto para proceder al control jurisdiccional de las exigencias legales,
llevando ante el juez competente a la persona que se supone ilegalmente
detenida.
Police, in its activity related to criminal proceedings carry out frequently the charge of a criminal offence against a specific person and, if it met certain circumstances provided for by law, is obliged to make the arrest. This article examines, from the perspective of the Spanish Law, some specific questions that arise around the concrete legal prerequisites, the various purposes which are pursued, the problems about the duration of the police deprivation of liberty, as well as the complexities of the legal regime of the detained person, also taking into account the special cases of the prosecution in fast processes, in terrorism cases, in minor detained cases and foreigners cases, and in addition the procedure laid down in particular to proceed with judicial review of statutory requirements in particular cases, bringing before the competent judge the person who is supposed to be illegally detained.
