Abstract
El presente estudio aborda el tema de la incorporación de la mediación
penal en Chile, como forma sustitutiva al actual proceso penal de
corte acusatorio, que integra el principio de oportunidad procesal y algunas
salidas alternativas al juicio oral, que por sí solas no responden íntegramentea
las necesidades de justicia de las personas. Con el objeto de conocer
cómo se aplica este mecanismo en Chile, se indagará sobre la aplicación
cuantitativa y cualitativa que se da a la mediación penal ofrecida por el
sector público en tres regiones significativas del país y sus consecuencias,
mediante el uso de una metodología exploratoria con algunos aspectos descriptivos,
a través del análisis de documentación consistente en doctrina,
recomendaciones de organismos internacionales, experiencia comparada y
un acotado trabajo de campo que recoge las percepciones sobre la calidad y
utilidad de la aplicación de la mediación penal de los operadores y usuarios
del sistema en esta muestra local pero representativa del país.
The subject of this study is the incorporation of the penal mediation in Chile as a replacement of the current form of accusatory criminal procedure. The latter includes the principle of procedural opportunity and some alternatives to oral trial that alone do not respond fully to the needs of justice. With the aim of familiarizing with the application of this mechanism in Chileand its consequences, we will inquire into the quantitative and qualitative information about thepenal mediation provided by the public sector of three significant regions of the country. We employ theexploratory methodology with some descriptive aspects through the analysis of documentation consisting of doctrine, recommendations of international organizations, comparative experiences and, finally, fieldwork which includes investigating perceptions about the quality and usefulness of the application by the mediation operators and system users in this representative local sample.
